Ubuntu and all of its flavors have a license for the use of the protected trademarks.

all of its flavors : "explaining why developers need to sign a license agreement"

"In short, Canonical has the right for the Ubuntu trademark and everything that goes with it".

http://news.softpedia.com/news/Canonica ... 6770.shtml

"everything that goes with it" ????

Open source: "the source code is available to the general public for use and/or modification from its original design"

"modification from its original design"

This has been the subject of several podcasts in the last few weeks. The mintCast podcast discuses the situation. mintCast No 187. I think Clem will eventually tell Ubuntu to, "go sit on it and rotate". I can see them moving all development over to LMDE. They are not going to get this type of grief from Debian. More worrying is, how is it going to affect the smaller distros that are based on Ubuntu. Naturally, Peppermint falls into this category and must be causing some concern for the developers. It is going to be interesting to see how they respond and what direction they take; if any.
